I have practiced nearly three decades in the area of explosive gas litigation. Many of those cases focused on the propane gas industry and the unfortunate propane gas explosions that injure and kill many Americans each year. As you can see by the article linked here, I have been recognized as a prominent lawyer by the propane gas industry.
The genesis the article linked here was generated by the editor of LP Gas magazine to initiate a discussion regarding safety practices within the propane industry. Mr. Hyland wanted to explore my viewpoint, as he knew that I have been representing victims of propane gas explosions for more than 25 years, and during the course of time had come into contact or sued nearly all of the leading marketers and manufacturers of propane. I agreed to do the article because my interest is in promoting safer practices within the industry. During the course of 25 years it became apparent to me that there are simple solutions to significantly decreasing the risk of a consumer being involved in propane gas explosion in his or her own home. In the article linked here, I set forth the straight-forward and economical solutions which I understand generated a firestorm within the propane industry.
Up until this time, the propane industry had contended that it was not the responsibility of the propane industry to mandate or insure that gas detectors were installed in consumer customer's homes. It had been the propane industry's position for a number of years that it was up to the consumer to decide whether or not to install gas detectors. Since the publication of the article there has been much discussion on this issue. Finally, in January of 2010 a leading proponent of the propane industry concerning safety matters who provides regular reports or articles to industry finally agreed with me that propane gas detectors should be made mandatory. Although he recommended that this be done through legislation rather than through the propane industry, it was nonetheless a significant step forward in safety.
As my article also pointed out there are several other steps or action that can be done to significantly increase safety for consumers. Another significant step is that consumers absolutely need to be told and warned never to touch the propane gas system other than to manipulate the thermostat. Explosions occur simply because consumers do not understand the dangers of attempting to relight pilot lights or other similar activities.
Consumers also need to know that if they have any sort of smell which they may perceive to be gas that they should immediately evacuate a house or structure without doing anything that might create a spark such as using the telephone or turning a light switch on. Consumers should know that leaking propane can smell different depending upon the circumstances. It is not always a consistent strong pungent odor associated with rotten eggs. Because of this it is normal for a consumer to smell a weak odor which is perceived to be non-threatening. Any odor however strong or weak must be treated as dangerous. Moreover, consumers should know that leaking propane may be present and you may not be able to detect any odor whatsoever.
